User Agreement

Terms & Conditions of Service - Top Staff app and website.

By using Top Staff app, Blackbooksair.com or Blackbooksair.co.uk (collectively referred to as the "Service"), you agree to these Terms and Conditions, Privacy Policy, and Cookie Policy. This User Agreement ("Agreement") is a legally binding contract between you and Top Staff Ltd. ("Top Staff").

We may collect and process personal data that you provide to us in order to provide the Service. By using our Service, you grant us permission to use your data as described in our Privacy Policy. You are responsible for the security of your account and device, and for ensuring that your account information is accurate and up-to-date. You may not use the Service if you are under 16 years old.

You agree not to copy or modify the app or any part of the app, or our trademarks, in any way. You may not attempt to extract the source code of the app or translate the app into other languages or make derivative versions. The app, trademarks, copyright, database rights, and other intellectual property rights related to it belong to Top Staff Ltd.

We reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will provide notice of any material changes to the Service, and will never charge you for the app or its services without making it clear to you what you are paying for.

The app uses third-party services that declare their own terms and conditions. By using our Service, you agree to familiarize yourself with those terms and conditions. We do not take responsibility for any loss or damage resulting from your use of those third-party services.

You are solely responsible for the way you use the Service. You agree that Top Staff is not liable for any loss, direct or indirect, you experience as a result of relying wholly on the functionality of the app. We cannot guarantee that the Service will always be available, uninterrupted, or error-free. We are not responsible for any charges you may incur from your mobile provider or internet service provider for using the Service.

We reserve the right to terminate your use of the Service for any reason, without notice. You agree not to use the Service for illegal purposes, to harass, threaten, or spam other users, or to create more than one account. If you have been banned from using our platform, you agree not to re-register.

We are not liable for any loss, damage, or inconvenience caused by your use of our app or website. We are not responsible for the accuracy or reliability of any content or information provided by third parties, nor are we responsible for any loss or damage caused by any errors or omissions in any such content or information. We are not responsible for any charges incurred by you as a result of your use of our app or website, including but not limited to roaming data charges.

We do not accept any liability for issues related to hiring or employment law. Employers are responsible for performing appropriate checks and due diligence to ensure that employees and freelancers have all the necessary paperwork. We do not condone or support any form of cash-in-hand jobs. By using our platform, you agree to take full responsibility for any hiring decisions you make and hold Top Staff harmless from any claims or damages arising from those decisions.

By using the Service, you agree to these terms and conditions, our Privacy Policy, and our Cookie Policy. If you do not agree to these terms, please do not use the Service.

User registration – Employer
Top Staff offers a free registration for employers, with premium features available for purchase. These premium features are available through a recurring subscription, and you will be billed on a monthly or annual basis. By purchasing a subscription or selecting an invoice, you agree to pay the applicable fees and taxes. Failure to do so may result in the termination of the services provided to you by Top Staff. To cancel your subscription, please do so in the "My Subscription" tab. The cancellation will take effect at the beginning of the next billing cycle. If your business changes category or if you would like to switch to an annual contract, please contact us.
All subscription purchases and invoices are final and non-refundable. If you purchase an incorrect subscription, we reserve the right to put your account on hold until the payment is processed. If payment is not completed within 14 days, we reserve the right to delete your account and retain the amount paid to cover administrative costs. If you repeatedly purchase an incorrect subscription, we reserve the right to delete your account and retain the amount paid to cover administrative costs.
By registering as an employer on our platform, you agree that you will use our Service only for legitimate recruitment purposes. You agree that you will not use our Service to discriminate against any candidate based on race, gender, religion, age, or any other protected status. You agree to comply with all applicable laws and regulations regarding the use of our Service.

User registration – Employee
By providing references, you agree that the nominated referees can be contacted by prospective employers. By providing a phone number and an email address, you agree that employers can contact you directly. You also agree that Top Staff may contact you at the email address or phone number provided during registration. Top Staff offers a free registration for employees, with premium features available for purchase.
By registering as an employee on our platform, you agree that you will provide accurate and up-to-date information about yourself. You agree that you will not use our Service to harass or discriminate against any employer or other user of the Service. You agree to comply with all applicable laws and regulations regarding the use of our Service.
